Brazil: heavy sentences in the case of the fire of a nightclub in 2013


They are two businessmen and two members of the musical group who were performing when the fire broke out in the Kiss nightclub, in the state of Rio Grande do Sul, due to a pyrotechnic device. , January 27, 2013.

They were tried for homicide on 242 victims, mainly young people, and attempted homicide on 636 other people, the wounded.

In front of the survivors and their relatives, judge Orlando Faccini Neto delivered the verdict on the tenth day of this trial, which was held in Porto Alegre.

With a seven-member jury, the magistrate heard testimony from 14 survivors, 19 witnesses and the four accused.

Elissandro Callegaro Spohr, 38, partner of the Kiss nightclub, received the heaviest sentence of 22 years and 6 months in prison, while his partner Mauro Londero Hoffmann, 56, was sentenced to 19 years and 6 months from prison.

Luciano Bonilha Leão, 44, music producer, and musician Marcelo de Jesus dos Santos, 41, were each sentenced to 18 years in prison.

The fire broke out in the early morning hours of January 27, 2013, during a party at this establishment in the city of Santa Maria, when a member of the group Gurizada Fandangueira ignited a pyrotechnic device that set the synthetic coating on the ceiling ablaze, trapping a thousand young people.

Many of them died charred or suffocated by toxic fumes as the room turned into a blaze. The two musicians had escaped in time from the disco without warning the young audience, although they had a sound system.

The investigation showed that the fire extinguishers were not working, that the signage was faulty and that only two doors allowed the evacuation of the crowd.
